Decree №42/2012 - On Determination of some election procedures

Based on paragraph 25 of article 8, paragraph 3 of article 14, paragraph 2 of article 30, paragraph 5 of article 77 of the Organic law of Georgia “Election Code of Georgia”, the Central Election Commission of Georgia resolves the following:

Article 1. On polling day, starting from the opening of election precincts (07.00 am) up to and including the period of drawing up summary protocols:

1. The persons authorized to be present at the polling place can be interviewed only outside of the polling place. The commission members can be interviewed only without obstruction to the fulfillment of the duties designated to them during the polling process.
2. Photo and video recording of polling booths at the polling place is inadmissible.
3. It is inadmissible to record in the polling place information or material that is not designated as public by the Election Legislation of Georgia, including the list of voters designated for the election commission (table version).

Article 2. On polling day, starting from 07.00 am before the appearance of the first voter to the election precinct and after the voting of the last voter, including the period of drawing up summary protocols, the persons authorized to be present at the polling place are entitled to conduct photo and video recording without obstructing the polling process, which means:

1. Photo and video recording in the polling place shall be conducted from a special place, allocated by the chairperson of the commission, from which the election process can be seen;
2. The minimum distance for photo and video recording for any person shall be not less than 3 meters away from the subject/object of recording;

Article 3. On polling day, including the period from the appearance of the first voter to the election precinct and after the voting of the last voter, the persons authorized to be present at the polling place are entitled to conduct photo and video recording without obstructing the polling process, which means:

1. Persons authorized to be present in the polling place can without hindrance conduct recording of the voting process when the voters are of high public interest, (officials holding political positions, leaders of election subjects and political unions, religious leaders), after which photo and video cameras shall be taken outside of the polling place.
2. One media company is entitled to conduct photo and video recording in one polling place once and for not more than 10 minutes. If the representative wants to conduct photo and video recording for more than 10 minutes, s/he must do so from a special place allocated at the polling place.
3. Persons authorized to be present at a polling place can conduct photo and video recording during the whole polling day from a fixed place determined by the chairperson of commission. The place shall be selected so that the ballot box shall be seen from there.
4. In the event a person authorized to be present at a polling place relocates or leaves the polling place, s/he loses the right to conduct recording.

Article 4. In the event of a violation of the norms determined by this decree, a Precinct Election Commission with a majority of votes can make a decision to expel the respective person from the polling place. Information on this shall be recorded in the logbook of polling day.

Article 5. This Decree can be appealed at the Tbilisi City Court, Administrative Cases Panel (address: Tbilisi, Davit Aghmashenebeli Alley, 12th kilometer, №6) within 2 calendar days upon its receipt.

Article 6. This Decree shall enter into force upon promulgation.
